Location

The FAO Legal Office provides in-house counsel in accordance with the Basic Texts of the Organization, gives legal advisory services to FAO members, assists in the formulation of treaties on food and agriculture, for which the Director-General acts as Depositary, publishes legal studies and maintains a database (FAOLEX) of national legislation and international agreements concerning food and agriculture (including fisheries, forestry and water).

Governmental Decree No. 123 of 1997 (VII. 18.) Korm. on the protection of freshwater stocks and water works for drinking water distribution.

This Decree applies to freshwater stocks which are already serving or will be used in the future for drinking water distribution and for mineral and medical water uses, and to establishments supplying, treating, storing and distributing such waters to at least an average of 50 persons. These water stocks and establishments must be highly protected according to this Decree. The provisions of this Decree set out rules for the determination and marking out of protection zones.

Sub-Decree on the delegation of authority to sign on land ownership, transfer of land ownership, and building constructions in Phnom Penh.

This Decree confers the right on the Royal Governmental Delegate to the Phnom Penh Municipality to sign on landownership, land transfer, and building construction in Phnom Penh. In the event of his absence, this Government officer shall delegate the authority to sign to any Deputy Delegate. (4 articles)

Law on State-owned Property Privatisation.

The present law determines the legal, economical, organizational and social principles as well as the basic terms of the privatisation of State property of Georgia and provides for the purchase of property owned by the State by physical or legal persons or their unions. The objective of this Law is to establish promote ownership and a market economy. Management and privatisation of State property is carried out by the Ministry of State Property Management. Article 4 specifies State property that is exempt from privatisation.

The State registration of rights to land shall form an integrated part of the land cadaster. Registration shall be carried nation-wide by the State Land Management Department and be managed by a Chief Registrar. A Zone Registrar shall manage registration in a specified zone. Powers of a Registrar are set out in article 7. Documents relative to land shall be registered within thirty days of their creation (art. 8). The Registrar may order registration under article 9.

Article 3 of this Decree further elaborates the concept, introduced by article 3 of the Law, of administration by the State of all land that is in ownership of the national community. Individuals are prohibited from using land as a commodity for sale. The Central Land Allocation and Land and Forest Land Granting Committee coordinates carrying out of land surveys and the allocation of land in accordance with articles 3 and 4. Other provisions deal with the protection of land rights, use of agricultural land, lawsuits and issue of rules by relevant ministries. (10 articles)
