El Reglamento de organización y funciones del Proyecto Nacional de Manejo de Cuencas Hidrográficas y Conservación de Suelos (PRONAMACHCS) consta de 4 títulos, 20 artículos, 2 disposiciones complementarias y 1 transitoria.

Le présent règlement grand-ducal modifie le règlement grand-ducal du 24 novembre 2000 concernant l’utilisation de fertilisants azotés dans l’agriculture. Notamment, on modifie, entre autres, l’article 8 établissant que les exploitants agricoles doivent disposer pour eux-mêmes ou s’assurer la disponibilité d’équipements appropriés servant au stockage des effluents d’élevage. These Regulations amend the Action Programme for Nitrate Vulnerable Zones (Scotland) Regulations 2008 so as to implement Commission Decision 2009/431/EC granting derogation to England, Scotland and Wales pursuant to Council Directive 91/676/EEC concerning the protection of waters against pollution caused by nitrates from agricultural sources.The Regulations provide for a derogation from the annual farm limit of nitrogen in livestock manure which may be obtained from the Scottish Ministers by an occupier of any grassland farm within a nitrate vulnerable zone.

By establishing an action programme for nitrate vulnerable zones these Regulation implement, as regards England and Wales, the requirement in this respect as laid down in article 5 of Council Directive 91/676/EC concerning the protection of waters against pollution by nitrates from agricultural sources. Regulation 3 requires an occupier of a farm or livestock unit comprising all or part of a nitrate vulnerable zone to ensure that the action programme set out in the Schedule is implemented. This Decree of the Ministry of Environment provides for the communication of projects and operations which may cause acute or substantial pollution problems. All operations listed in section 3 shall be communicated to the State Pollution Supervision and Control Agency. They include production of pesticides and chemical fertilizer (urea). Communication of plans or operations shall include information specified in section 3. Risk assessment and information regarding pollutant contents shall be included in the communication. This Regional Act lays down the legislative framework concerning the protection of soil, water resources and coastal territories in Toscana. The Act establishes principles for the adoption of programmes, plans and projects to undertake interventions that have an impact on such resources. A Commission for Soil Protection is established (art. 4). Provisions on monitoring and penalties are laid down too.

The products to which the Regulations apply (defined in regulation 2) must comply with the requirements listed, by reference to the relevant Community legislation, in Schedule 1. Trade samples and products intended for exhibition or study or analysis are exempt from the Regulations (regulation 3(1)). Products intended for personal use which comply with the conditions in regulation 3(3), are exempt from all but a few of the regulations. Regulations 4 and 16 define the authorities that enforce the Regulations. Regulations 7, 8 and 9 confer the necessary enforcement powers.

As a result, a European Community programme of policy and action in relation to the environment and sustainable development is hereby laid down.
