The derogation requested by the United Kingdom with regard to England, Scotland and Wales for the purpose of allowing a higher amount of livestock manure than that provided for in the first sentence of the second subparagraph of paragraph 2 of Annex III to Directive 91/676/EEC and in point (a) thereof, is granted, subject to the conditions laid down in this Decision.

The Regulation of the Minister of Environment, which is composed of two paragraphs and two Annexes, establishes new conditions which have to be fulfilled while inserting sewage into water or land, and amends the list of substances particularly harmful to water environment. Annex 1 specifies maximum values of pollution indicators for treated industrial sewage. Annex 2 lays down referential methodologies of sewage samples analysis.

Water Act 1989 (Chapter 15).

The Water Act 1989 sanctioned a major shift in the policy of the government towards severing the public utility function from the comprehensive scope of water management authority of the Regional Water Authorities operating in England and Wales, and entrusting it with limited public companies. The regulatory functions hitherto vested in the said authorities, augmented by the addition of regulatory functions with respect to navigation, river conservancy and harbours are vested in a National Rivers Authority.

Regulation respecting the prevention of water pollution in livestock operations (R.Q. c. Q-2, r.18)

The present Regulation lays down provisions relating to the prevention of water pollution in livestock operations. Section 2 establishes that no person shall construct or undertake to operate a new livestock operation, expand, change types of livestock or increase the number of animal units, or install or modify a manure storage site without having obtained a certificate of authorization for that purpose from the Minister.

The Decree regulates the discharge of the substances contained in Lists I and II of Annex A into surface waters, marine territorial and coastal waters. It regulates also the powers and duties of the Government and of the Regions, with particular regard to the establishment and implementation of measures for the protection of the environment. The discharge of dangerous substances must be authorized by the Province or the competent sewerage service. The authorization has a validity of four years and is renewable according to the procedure of article 9.

This Act makes provision for the protection of the environment, in particular of water resources, air and soil, in Papua New Guinea, establishes the Environment Council, defines functions and powers of the Director of Environment and provides for other matters relating to administration in relation with the provision of this Act.The Act specifies at the outset its objectives and how these objectives shall be achieved. It also defines matters of national importance in relation with the environment and a general environmental duty and prohibits the causing of environmental harm.

Long Leases (Scotland) Act 2012 (2012 asp 9).

This Act converts ultra-long leases (i.e. leases that were let for over 175 years and that have over 100 years left to run from the appointed day) into ownership. Certain leasehold conditions to real burdens. The Act also covers compensation for loss of landlord’s rights and provides exemption from conversion and continuing leases. The conversion of qualifying leases to ownership is automatic, unless the tenant chooses to opt. The Act extinguishes all rights and obligations arising from the qualifying lease and any superior lease.

Local Land Services Regulation 2014.

This Regulation, consisting of 104 Sections, divided into 13 Parts and completed by two Schedules aims at Local Land Services is to make and levy the following rates for each year: a) a general rate on all rateable land, b) an animal health rate. The rates may be made in the previous year but must be made by 31 March of the year to which they relate. Under clause 25, the Minister may extend the time within which the rates may be made.

The purpose of this Directive is to achieve integrated prevention and control of pollution arising from certain industrial activities (those listed in Annex I), including energy and mineral industries, production and processing of metals, chemical industries and waste management. These provisions set out measures to prevent or reduce emissions into the air, water and land, without any prejudice to Directive 85/337/EEC and other relevant European Community provisions. In particular, the Directive defines the legal framework for issuing permits to carry out the activities above-mentioned.
