This Act makes provisions for matters of inheritance and other matters of succession to title in real estate and personal property.The Act concerns, among other things, lease intestacy trust, escheat to the Crown, powers of Court, administration of estates of a deceased person and contracts to leave property by will.

Corporate Bodies' Lands Act (No. 2) 1936.

This Act requires a body corporate acquiring land at certain conditions or a body corporate that disposes of such land to deposit a memorandum on the transaction in the office of Registrar-General. Failing to do so constitutes an offence. The Registrar-General shall keep a register, by parishes, of land held by bodies corporate in Bermuda and shall annually report on this to the Governor, for the information of the Legislature.

Trusts Restriction Act (Cap. 63).

This Act places restrictions on the creation of settlements, trusts and future interests in relation to rights in land and other property.Subject to certain exceptions, the Act prohibits the settlement of property, the limitation of any property in trust for another or any vesting in possession of property at a future date. Exceptions concern, among other things, tenancy for life and tenancy in common. The Act also defines the effects of any dispositions made contrary to this Act.

Administrator-General's Act (Cap. 59).

This Act makes provision for the appointment of the Administrator-General and defines functions and powers of this public office. The Administrator-General shall be responsible principally for the administration of estates of deceased persons leaving property in Zambia.The Administrator-General shall be a corporation and an Administrator-General and as many assistant Administrators-General as necessary shall be appointed by the Public Service Commission. The Administrator-General shall be responsible for the administration of estates.

Estates Tail Barring Act (Cap. 143).

This Act defines full rights and powers of an actual tenant in tail, whether in possession, remainder, contingency or otherwise, to dispose of for an estate in fee simple, absolute, or for any less estate, the lands of which he or she is tenant in tail. A deed by which any disposition is made by a tenant in tail shall be recorded in the Registry of Records, within six months after the execution thereof.

Rule against Perpetuities (Application to Future Easements) Act (Cap. 146).

For the avoidance of doubt, this Act declares that the rule against perpetuities shall apply to future easements and such easements shall be void. The Act also stipulates that a covenant not to interfere with the exercise of rights which, if directly granted, would constitute an easement declared void under this Act, shall not be enforceable against a purchaser of land affected thereby.

Unrepresented Estates Act.

This Act makes provision for the administration of unrepresented estates (as defined) by the Administrator of Estates appointed under this Act. After receiving, upon application to Court, an order, the Administrator of Estates shall forthwith take possession and cause an inventory of the estate mentioned in such order to be made, and shall file the inventory in Court. The Act makes provision for administration and sale of estates by the Administrator.
