Perpetuities and Accumulations Act (Cap. 161).

This Act provides for matters relating to interests, i.e. perpetuities and accumulations in (immovable) property. It, among other things: provides for the vesting of the interests, duration, interests regarding (leases of) land, restrictions on accumulations in general, and restriction on accumulation for the purchase of immovable property.

This Act provides rules relative to succession in case of death. The Act makes provision, among other things, for: court jurisdiction and powers; probate and administration of estates; Distribution of real and personal estate of intestate; and caveats. If an executor who has obtained probate, or an administrator with the will annexed, after request in writing neglects or refuses to: execute a transfer of land devised to a devisee such devisee may apply to court for an order upon such executor or administrator to comply with such request.

This Ordinance concerns the procedures for control of administration of estates of deceased persons. The Supreme Court shall continue to have jurisdiction in all matters concerning the administration of Estates. Every application for a grant of probate or of letters of administration shall be made by affidavit filed with the Registrar of the Supreme Court. The Ordinance defines the duty of every personal representative (i.e. a person to whom a grant is made).

This Act regulates inheritance by will of real estate and other property. The Act concerns, among other things: the drafting and interpretation of wills; the capacity to make wills; property disposable by will; validity of wills; and devise of real estate to more than one person.

This Act regulates certain aspects of trusts, i.e. a legal relationship created, either inter-vivos or on death in which assets are placed under the control of a trustee for the benefit of a beneficiary or for a specified purpose. Matters regulated include: governing law; capacity to create trusts; and jurisdiction of the Supreme Court. One Part of the Act is dedicated to special purpose trusts, i.e. trust created for a non-charitable purpose or purposes. No interest in land in Bermuda shall be held, directly or indirectly, in a purpose trust.

Public Trust Office Act 1975.

This Act establishes an office to be called the Public Trust Office and provides for the appointment of the Public Trustee. The Public Trustee shall be responsible for the management of the Public Trust Office. The Public Trustee may be appointed executor, administrator or trustee by trust instrument. The Act also defines the powers and duties of the Public Trustee in respect of land affected by a mortgage or security.
