Land Settlement (Perpetual Leases of State Land) Act (Cap. 108).

This Act provides for the grant by the Government of perpetual leases, i.e. leases of State land granted for the purposes of land settlement, which shall endure in perpetuity unless they lapse or are terminated or surrendered. Perpetual leases of State land may be granted for purposes of land settlement and shall be subject to terms and conditions stated in them and in provisions of this Act. Transfer, mortgage, etc. of a lease shall be subject to permission of the Government.

This Act makes provision for the administration of (intestate) estates by persons appointed as administrators under this Act or by (probate of) will and also concerns other related matters of inheritance. Real estate (including lease) of a person dying intestate shall devolve in the manner provided by section 4, and the residuary estate of that person shall be distributed in accordance with section 54.

Estates of Deceased Foreigners Act (Cap. 198).

This Act makes provision for the administration of estates in Belize of deceased foreign persons. It assigns powers to representatives of specified countries of origin of the deceased person to administer the estate if there is no person present in Belize at the time of death who is rightfully entitled to administer the estate of such deceased person. Nothing contained in this Act shall affect the Crown’s right under the Administration of Estates Act. The representative shall apply for letters of administration to be issued by court.

These Regulations concern action, other than a non-contentious action, for the grant of probate of the will or of letters of administration of the estate of a deceased person, for the revocation of a grant or for a decree pronouncing for or against the validity of an alleged will. They also concern administration of estates of the estate of a deceased person. There is established a Probate Registry in which all applications and grants and all matters connected therewith are registered.

This Law provides rules for the making of wills and other matters regarding inheritance. It provides, among other things, that in every collateral succession on intestacy, whether to movable or immovable estate, the rule by which the paternal side excludes the maternal side in equality of degree is abolished. It also provides for devolution of immovable estate on intestacy and amends customary law so as to provide for equality of succession rights of legitimate and illegitimate children.

Probates (Re-sealing) Act.

This Act provides for the re-sealing of probates and letters of administration granted in Commonwealth countries and a State of Nigeria. The Act defines conditions to be fulfilled before re-sealing and effects of re-sealing. The High Court of a State may, if it thinks fit, on the application of any creditor, require, before re-sealing, that adequate security be given for the payment of debts due from the estate to creditors residing in that State.

This Law makes provision with respect to registration of title in land and effects of registration and provides for a wide variety of matters regarding specific title in land such as leases, charges, transfers, co-ownership and partition, trusts and transmission on death.The Law establishes a Land Register and requires the Governor to appoint a Land Registrar, the functions and powers of which are defined by this Law. The Land Register shall consist of a register of parcels adjudicated under the Land Adjudication Law and a register of each lease required by the Law to be registered.

These Regulations amend the Regulations in terms of the Deeds Registries Act in: regulation 29 on the description of immovable property; regulation 43 on the form of a deed of transfer, certificate of title or deed of cession; regulation 44A on the deeds of churches, corporations, etc.; regulation 61 on acceptance by the Registrar of Deeds; regulation 68 on procedural requirements for the cancellation of a bond; regulation 73 by substitution and addition of forms.
