Recording of Documents Regulations.

These Regulations, made under section 5 of the Registrar-General (Recording of Documents) Act 1955: provide rules relative to the form of documents submitted to the Registrar-General for recording or registration; appoint authorized officers for purposes of the Act; and require the metric system to be used for measurements in documents, including survey plans. Forms for the Memorandum of mortgage, Memorandum of acquisition of land from and/or by alien and a Memorandum relative to voluntary conveyances are set out in the Schedule.

The present Law lays down provisions relating to the keeping of the land register in Saarland. Land survey as well as running the land register are both public tasks which according to article 2 of the present Law are carried out by the Cadastre, Survey and Mapping Office and other public entities. The text consists of 23 articles divided into 5 Parts as follows: General provisions (I); Land survey (II); Land survey register (III); Survey and fixing of borders (IV); Penalties (V).

The asset register of state-owned agricultural, forestry and other lands must be kept by the National Land Fund Managing Organization. This Decree determines the kind of information to be included in the register, such as data regarding the location of the property or information regarding rights and obligations on a property.

Land Survey Law.

The present Law lays down provisions relating to land survey and the running of the land cadastre. Article 1 of the above-mentioned Law lists the functions of the official surveying and mapping, such as: 1) national land survey; 2) running of land cadastre; 3) conducting property surveys, including demarcation of parcel of lands; 4) producing evidence of borders; 5) providing geo-data information.

The Cadastral Diagram represents the detailed form of information contained in the database of the National Cadastre and it constitutes the background basic information on which the Diagram of geometric amendments is depicted. With this Diagram, changes on delimitation of land can be requested. The Decree prescribes the information which must be included in the Diagram and establishes that its issuance shall be free of charge for the public administration.

Order No. 475 of the Ministry of Economic Development validating the list of documents required for acquisition of rights to a plot of land.

The following list of documents shall be required for acquisition of rights to a plot of land: (a) personal identity document for applicants – natural persons; (b) copy of registration certificate for applicants – legal persons; (c) land ownership certificate (for vendor); and (d) cadastre certificate.

These Rules set out procedures and requirements for the conduct of surveys.The Rules provide for requirements and conditions that registered surveyors must comply with, including: survey documents to be submitted to the Chief Surveyor; testing of field equipment used for cadastral survey; abbreviations, signs and symbols to be used in survey documents; certificates; and plan forms.The Rules provide in detail procedures necessary to conduct survey of land lots and strata lots.
