Land Improvement Act.

This Act provides the requirements for the designing, building and management of land improvement systems, the specifications for the foundation and operations of land improvement associations operating as non-profit associations, the procedure for exercising state supervision over implementation of this Act, and liability for violations of this Act. A regulation network shall ensure that the soil water regime is suitable for crop husbandry and shall minimize the threat of the spread of pollution.

Agricultural Returns Ordinance.

The Director of Agriculture is hereby empowered to require returns to owners of any agricultural land or farmhouse in Malta. Owners of agricultural lands or farmhouse shall, in case of change of the ownership, inform the Director of Agriculture. Further are set out the penalties to be applied in case of contravention of the present provisions.

Ministerial Decree approving the official methods of biochemical analysis of soil.

In view of the fact that a good knowledge of the biochemical characteristics of soil is necessary in order to arrange and implement a sound national policy for programming the use of soil and waste water for irrigation purposes, this Decree approves the official methods to be applied in the biochemical analysis of soil.

Land Registration Rules.

These provisions aim at implementing the Land Registration Act, particularly as regards the application for the registration of land or the issue of a certificate of title and application for registration of acquistion by prescription. Article 13 concerns appeals against the decisions of the Registrar; article 14 concerns claims for indemnity. Several schedules, containing the models of the forms of the applications and certificates hereby envisaged, are attached.

Agricultural Leases Regulations.

These Regulations make provision on leases relative to agricultural lands. The Registrar of the Superior Courts is designated to be the Registrar of the Board in regard to any proceedings which concern land situated in the Island of Malta. With respect to proceedings concerning land situated in the Island of Gozo or Comino, however, the Registrar of the Court of Magistrates of Gozo shall have such competence. Regulation 4 defines the content of applications to the Board.

This Act empowers the Director of Agriculture to make Land Preservation Orders under section 3 for purposes set out in subsection 2 of section 3. In such Orders the Director may, for reasons of protection of soil and other preservation of land, prohibit, regulate or control braking or clearing of land for cultivation, grazing of livestock, and the destruction of vegetation and may require or regulate afforestation, protection of slopes or catchment areas, drainage of land, supervision of abandoned land, and the use of land for agricultural purposes.

Agricultural Leases (Reletting) Act.

This Act establishes rules governing the reletting of agricultural land. Where a lessor desires to make any change in the conditions of a lease on the expiration of its term, unless an agreement is reached with the tenant, he shall apply to the Rural Leases Control Board (which is established under article 5) and indicate the proposed changes. The Board may reject, approve or modify the new conditions proposed by the lessor. Article 4 regards the non-renewal of lease.

Land Acquisition (Public Purposes) Ordinance.

The Ordinance lays down rules governing the acquisition of land for public purposes, which means any purpose connected with exclusive government use or general public use. The President of Malta may by declaration signed by him declare any land to be required for a public purpose. Moreover, the President of Malta may for any public purpose declare by proclamation that any land is subject to clearance rights or to subsoil rights.

El presente Decreto reforma el párrafo segundo del artículo 15 de la Ley de Reforma Agraria estableciendo que el Instituto Nacional Agrario (INA) exigirá la inmediata devolución de todas las tierras nacionales y ejidales que estén ilegalmente en poder de particulares, a excepción de quien acredite la ocupación de tierras inferiores a 200 hectáreas y su explotación en sistemas agroforestales o silvopastorales, cultivos intensos o crianza de animales en confinamiento.

Pounds Act (R.S.Y. 2002, c. 173).

This Act concerns pounds and the construction of fences for the protection of the ground within its bounds from animals, including horse, cattle, swine and geese. Under section 4, when an animal trespasses any lawful fence, the owner of the land shall return the animal to the nearest pound keeper or district and the owner of the animal is responsible for damages caused to the land or the fence. Under section 6, the owner or occupier of land where an animal is kept, or the person in charge of the animal, is liable for any damage done by the animal as if the animal were of their property.
