A Decree to provide for ownership, allotment, use, registration of residential land and houses by citizens of Viet Nam and leasehold by foreigners, and in relation to this the assignment of title, the issue of certificates, settlement of disputes and other matters. The State recognises and protects the lawful title to residential houses and lawful right to the use of residential land. All residential houses and land must be registered. The lawful owners are issued the certificate of residential house title and residential land use right.

These Instructions establish the modalities of the registration of the contracts of granting of the share of land on lease. The contract of lease can be concluded by the owner of the share of land (Landlord), and an agricultural enterprise or a farmer (Lease-holder). Either a single landlord or a group of landlords can grant on lease shares of land. In the latter case the contract of lease is concluded with multitude of physical persons on the part of landlords.

This Law establishes that the utilisation of land is charged. Land charges consist of : land tax, ground-rent and normative land price. Landowners and land tenants, except for lease-holders, are charged with annual land tax. The plots of land given in lease are charged with ground-rent. Normative land price is fixed for the purpose of purchase and redemption of the plots of land in cases envisaged by the Land Code and for the purpose of obtaining land based credit. This Law sets forth basic procedures and rules for the defining and allocation of pasture areas to various villages and municipalities. The Ministry of Agriculture and Rural Affairs is authorized to determine the boundaries of pastures and their allocation to relevant entities. The procedure for this application is clearly defined in the Law. The finalized boundaries are then recorded to corresponding title deeds. Allocation process is renewed every five years.

This Decision concerns the reconstruction of agricultural cooperatives. It consists of 12 articles providing for the distribution of the agricultural lands between cooperatives. It states that these lands must be given to the families of the agricultural cooperative members. Land leasing shall be allowed when these members are citizens. It specifies the measures to be applied in order to calculate land surface, limits, duration of concession, competent authorities entitled to perform this activity, the use of the money gained from the sale.
