A key challenge facing South Africa’s economic development is overcoming the structural poverty created through the systematic dispossession of the majority of its citizens. Although radically marginalized during apartheid, there is poor public acknowledgement of the losses experienced by those families who, through the passing of various racially biased, land and labour laws, became farm labour on commercial farms.

The Act regulates succession in Estonia. Specifically, it provides that succession is the transfer of the property of a person upon his or her death to another person. A bequeather is a person whose property transfers upon his or her death to another person. An estate is the property of a bequeather. An estate does not include the rights and obligations of the bequeather which pursuant to law or by their nature are inseparably bound to the person of the bequeather. Notably, special rules govern the legal relations involving the property that is included in the land register.

This paper examines the impact of land reform on agricultural productivity in Tajikistan. Recent legislation allows farmers to obtain access to heritable land shares for private use, but reform has been geographically uneven. The break-up of state farms has occurred in some areas where agriculture has little to offer but, where high value crops are grown, land reform has hardly begun. In cases where collectivized farming persists and land has not been distributed, productivity remains low and individual households benefit little from farming.

Dit rapport schetst de methoden, resultaten en implicaties voor beleid van een onderzoek onder grondeigenaren naar hun belangstelling, motieven en knelpunten bij natuuraanleg volgens de functieverandering van de Subsidieregeling Natuurbeheer. Het onderzoek omvatte drie delen: een gericht op grondeigenaren, een gericht op deelnemers aan de functieverandering en een gericht op grondeigenaren die geprobeerd hebben functieverandering te realiseren, maar waarvan de pogingen gestrand zijn.

Dit rapport bevat een evaluatie van de rol van provincies bij de functiewijziging van landbouwgronden naar gronden met een functie natuur, als onderdeel van de omslag in het Natuurbeleid. Hierbij worden minder gronden voor natuur verworven voor beheer door terreinbeherende organisaties, en meer gronden door particulieren in beheer genomen. Via documentanalyse en interviews met provincies is geanalyseerd hoe ze deze omslag vormgeven en zijn conclusies getrokken over de kansrijkheid van de omslag.

Failings in governance have adverse consequences for society as a whole. By contrast, good governance can help achieve economic development and the reduction of poverty. Good governance matters.

The present paper – the third in the HIV/AIDS Programme Working Paper Series – is based on field research conducted by two grassroots organizations – CINDI-Kitwe in Zambia and GROOTS Kenya in Kenya to map out and document cases of property grabbing from children, in particular those who became orphans due to AIDS. It is intended to explore methods which grassroots organizations use or can use to document their work.
