Part II deals with sub-division of agricultural land, and regulates the common use and administrative matters. Part III concerns competent authorities and proceedings. This Act empowers the Director of Agriculture to make Land Preservation Orders under section 3 for purposes set out in subsection 2 of section 3. In such Orders the Director may, for reasons of protection of soil and other preservation of land, prohibit, regulate or control braking or clearing of land for cultivation, grazing of livestock, and the destruction of vegetation and may require or regulate afforestation, protection of slopes or catchment areas, drainage of land, supervision of abandoned land, and the use of land for agricultural purposes.

The Act, consisting of 15 Parts completed by 17 Schedules, concerns the management of public land in the territory of Victoria. This Act provides that the Minister may appoint an officer to partition and re-allot of areas described in the Schedule. The powers of such person are the same as officers appointed under District Lands Partition and Re-allotment Act, being the principal Act. The Minister may under certain conditions change the Schedule to this Act. (4 sections)

Regional Law No. 14-RZ “On turnover of agricultural land”.

This Regional Law regulates the issues of agricultural land. It establishes that minimum consolidated land area of agricultural land shall be 0, 1 ha and maximum agricultural land area located within the boundaries of a single municipal unit that can be owned by a single natural or legal person shall not exceed 10 percent of total available agricultural land area. Minimum period of lease of plots of agricultural land shall be set forth as follows: (a) for haymaking and grazing – 3 months; (b) for growing of annual plants – 9 months; and (c) for growing of perennial plants – 3 years.

This Regional Law regulates some issues in the sphere of land relations except for those related to agricultural land. It establishes minimum and maximum land areas for land plots pertaining to public and municipal land in ownership to citizens in accordance with the following criteria: (a) gardening – from 0, 05 ha to 0, 15 ha; (b) horticulture – from 0, 02 ha to 0, 10 ha; (c) for stockbreeding – from 0, 02 ha to 0, 10 ha; (d) suburban housing construction – from 0, 06 ha to 0, 25 ha; and (e) peasant farming – up to 75 ha, including agricultural land – up to 50 ha.

This Regional Act sets forth rules and principles governing the conservation of soil, which is deemed to be a non renewable resource, essential for the protection of landscapes and ecosystem preservation. The regional authority, as well as local entities, are responsible for coordinating development policies and the preservation of surfaces of agricultural lands. To this end the Act provides for the identification of agricultural lands falling within the regional territory (art. 2) and provides for the lease of land to young farmers.
