The FAO Legal Office provides in-house counsel in accordance with the Basic Texts of the Organization, gives legal advisory services to FAO members, assists in the formulation of treaties on food and agriculture, for which the Director-General acts as Depositary, publishes legal studies and maintains a database (FAOLEX) of national legislation and international agreements concerning food and agriculture (including fisheries, forestry and water).

Land Titles Repeal Act (S.C. 1993, c. 41).

For the purpose of the present Act “Territory” means Yukon or the Northwest Territories, as the case may require. Section 3 establishes that when the Commissioner in Council of a Territory has enacted a land titles ordinance to replace the Land Titles Act, the Governor in Council may, by order, repeal the Land Titles Act. The text consists of 8 sections.

Nunavut Waters and Nunavut Surface Rights Tribunal Act (S.C. 2002, c. 10).

Together with the Nunavut Land Claims Agreement, the present Act establishes the Nunavut Surface Rights Tribunal. The Tribunal is responsible for regulating entry and access to lands, for determining rights of, and compensation payable to, the titleholder and for determining the amount for wildlife compensation claims in the Nunavut Settlement Area. Section 14 establishes the Nunavut Water Board.

Westbank First Nation Self-Government Act (S.C. 2004, c. 17).

The present Act validates the Westbank First Nation Self-Government Agreement between Her Majesty the Queen in Right of Canada and Westbank First Nation of 3 October 2003. In particular, section 3 establishes that the Agreement is approved and has the force of law. The text – consisting of 22 sections – deals with the following aspects: effect of Agreement, interpretation, application of other Acts, legal proceedings, general provisions.

Westbank First Nation Land Registry Regulations (SOR/2007-232).

The present Regulations are made under the Westbank First Nation Self-Government Act. In particular, the Regulations set up the Westbank First Nation Land Registry which is a sub registry under the Self-Governing First Nations Land Registry held in Ottawa. It is a public registry that is password protected and can be accessed at no charge through the Helpdesk on the systems login page. Section 2 establishes that the Register shall be maintained in an office located in the National Capital Region and known as the Westbank First Nation Land Registry. The text consists of 34 sections.

Nunavut Waters Regulations (SOR/2013-69).

The present Regulations are made under the Nunavut Waters and Nunavut Surface Rights Tribunal Act and the Nunavut Land Claims Agreement Act. In particular, the Regulations make it possible for some mining projects to use and get rid of waste water without a water license. Moreover, they establish the minimum threshold for a project’s use of water and/or deposit of waste without applying for a licence. They also simplify rules on the use of water and deposit of waste, set up additional water management areas, and aim to improve spill reporting and record keeping.
