The present Regulations are mande under the Provincial Lands Act, 2016. In particular, the Regulations provide for use and ownership of agricultural land in the Province of Saskatchewan. Furthermore, the Regulations address the issue of foreign ownership, sale of provincial land, agricultural leases, leases for oil and gas development or mineral development.

The present Regulation is made under the Land Titles Act, 2015. In particular, the Regulation provides for the correct and efficient enforcement of the aforementioned Act. Section 1 establishes that a Yukon First Nation is eligible to apply to bring its settlement land under the Act and have a certificate of title issued for that land if its final agreement or selfgovernment agreement provides that the Act applies to its settlement land registered in the land titles office.

This new Provincial Lands Act aims to modernize the legislative framework and provide better environmental. In particular, the Act provides for better protection for Crown land by investing the government with the ability to respond and take action when land is being misused, such as issuing immediate stop work orders. Furthermore, the framework for the Ministry of Agriculture Crown leases shall be used as security; and the time period of certain long-term leases where significant investments are possible, such as wind power development shall be increased.

The present Regulations are made under the Surface Rights Acquisition and Compensation Act. In particular, section 3 establishes that “mineral” includes potash according to clause 2(e) of the afore-mentioned Act establishing that “mineral” means petroleum and natural gas, or either of them, and any other substance that the Lieutenant Governor in Council may by Regulation establish. The text consists of 4 sections.
