Article 2 shall be amended to add the following wording: “Plots of agricultural land shall be allotted to specific categories of citizens for agricultural production, other purposes related to agricultural production, for suburban farming and for individual housing construction”.

This Regional Law regulates the issues of allotment once-only free of charge of agricultural land plots out of stock of public and municipal land in ownership to some categories of citizens, including multiple children (three and more) families, for peasant farming, subsidiary smallholding, horticulture, gardening and suburban individual housing construction. Order on allotment of land shall be issued and legalized by local government.

This Regional Law establishes cases of allotment of land plots free of charge in ownership to citizens with three and more children out of stock of public or municipal land. Land plots can be allotted to the aforesaid category of citizens for the following purposes: (a) individual housing construction; (b) suburban housing construction; (c) gardening and horticulture; (d) stockbreeding; and (e) farming.

This Regional Law establishes maximum land area limits for plots of agricultural land allotted on condition of ownership to citizens out of stock of public or municipal land as follows: (a) for peasant farming – 30 ha; (b) for horticulture, gardening, stockbreeding, suburban housing construction out of stock of low yield agricultural land – 1.500 square metres; and (c) for subsidiary smallholding – 5.000 square metres.

Article 7-1 shall be amended to add the following wording: “Citizen interested in obtaining in ownership plot of land shall submit written application to the local government containing a copy of identity card or other identifying document and birth certificate (adoption certificate) of children or copies of identity cards thereof”.

Article 2 shall be amended to add the following wording: “Maximum land area of the plots of agricultural land allotted free of charge to citizens out of the stock of public and municipal land in ownership shall be set forth as follows: (a) for horticulture, gardening, stockbreeding, suburban housing construction – 0.15 ha; and (b) for subsidiary smallholding – 0, 5.ha; and (c) for individual housing construction in rural areas – 0, 15 ha”.

This Order classifies authorized uses of land plots and, in particular, use of agricultural land for plant cultivation, crops, horticulture, gardening, cultivation of medicinal plants, flax, hemp, ranching, stockbreeding, poultry farming, apiculture and fishfarming.

In the whole text of the document shall be added the wording “peasant farm shall perform its activity in the sphere of gardening”.

La presente Ley dicta normas de distribución de terrenos baldíos a familias pobres del país con fines sociales y productivos, disponiendo que el Consejo Directivo del INCODER señale para cada región o zona las extensiones máximas y mínimas adjudicables de los baldíos productivos en Unidades Agrícolas Familiares.

El presente Acuerdo expide el Estatuto Orgánico de Gestión Organizacional por Procesos del Ministerio de Agricultura, Ganadería, Acuacultura y Pesca (MAGAP), que es la institución rectora del multisector, para regular, facilitar, controlar y evaluar la gestión de la producción agrícola, ganadera, acuícola y pesquera del país, promoviendo acciones que permitan el desarrollo rural y propicien el crecimiento sostenible de la producción y productividad del sector, impulsando al desarrollo de productores, en particular representados por la agricultura familiar campesina, manteniendo el incentivo

El presente documento establece a nivel nacional el plan de desarrollo humano, que contempla líneas de acción y medidas para erradicar la pobreza, garantizar el respeto de los derechos de las personas a satisfacer sus necesidades básicas (alimento, vivienda, salud, educación y seguridad) y conseguir una vida digna para todos los nicaragüenses. El Plan es de carácter intersectorial y abarca el período comprendido entre el 2012 y el 2016.

Por la presente Ley se declara de interés público la agricultura familiar, campesina e indígena por su contribución a la seguridad y soberanía alimentaria del pueblo, y por practicar y promover sistemas de vida y de producción que preservan la biodiversidad y procesos sostenibles de transformación productiva.
