Hamburg Expropriation Law.

The present Law lays down provisions relating to land expropriation procedures in the Land Hamburg. Article 1 establishes that an expropriation is only authorized if it improves the well being of the community. An adequate compensation is to be paid for every expropriation.

Les immeubles et droits réels immobiliers appartenant aux personnes physiques ou morales de nationalité congolaise ou étrangère sont soumis aux dispositions de la présente loi. L’immatriculation d’un immeuble consiste à établir un titre foncier et à l’inscrire dans le registre de la propriété foncière. Elle a pour objet de placer l’immeuble qui y a été soumis sous le régime de la propriété foncière sans qu’il puisse en être ultérieurement soustrait et est obligatoire.

This Legislative decree is composed of seven Titles divided in 92 articles. It defines principles and rules related to land use of both public and private bodies. Land is considered to have a socio-economic and ecological function and therefore it must be used in a sustainable manner. The Decree rules on public and private domain and provides land classification. Particular attention is paid to regulate land sale, rent and concession. Finally, the Decree provides for a land register.

The purpose of the state land use planning, state land cadastre and land monitoring shall be rational management of land and environmental protection. Basic principles of the state land use planning shall be: (a) respect for the rights of landowners; (b) use of land resources prevalently for agriculture; and (c) creation of favourable conditions for rational land management and improvement of soil fertility. The Act consists of four Sections divided into 22 articles: (1) general provisions; (2) the state land cadastre; (3) land monitoring; and (4) state land survey service.

This Act makes provision for administration and enforcement in relation with the presence of hazardous substances in or over land.Various public bodies are appointed as authorities at state and local level for purposes of this Act. The Act prescribes that the presence of a hazardous substance on, over or under land requires the consent of the hazardous substances authority. For the purposes of this Act the Secretary of State shall by Regulations specify: (a) the substances that are hazardous substances; and (b) the quantity which is to be the controlled quantity of any such substance.

This Act concerns land use planning in the State of Pohnpei. Its objectives are to promote responsible and balanced development, to preserve and enhance cultural and traditional values, to conserve and protect the natural environment, and to assure adequate provision for community facilities and requirements. All use of land, both public and private, must be consistent with provisions of this Act.The Act establishes the Pohnpei Land Use Planning and Zoning Commission. The Commission shall prepare a master land use plan, the scope and contents of which are set out in this Act.
