This Law regulates various matters relating to real property (not defined) such as disposal, registration of title and other rights, and rights in and over real estate such as liens. The Act consists of 21 Chapters divided into 5 Parts.Part 1 provides rules for the sale and acquisition of real estate. Title to real estate is acquired by sale, trade, gift or other conveyance, as provided in this Code. Separate provisions apply to the acquisition of real estate by inheritance, will, distribution of matrimonial assets, expropriation or otherwise not by conveyance.

This Act regulates the acquisition of the right to own or use real property in Iceland. It provides for the control of State organs of the purchase of titles in real property by foreigners. No one may acquire the right to own or use real property in Iceland, including fishing and hunting rights, water rights or other real property rights, whether by free assignation or enforcement measures, marriage, inheritance or deed of transfer, unless it is an individual who is domiciled in Iceland or is an Icelandic citizen.

The Federal Law No. 102-FZ must be supplemented with the additional Article 64/1 regarding mortgage of the plot of land purchased with the use of land based credit stating that the aforesaid plot of land shall be considered mortgaged from the moment of the state registration of property rights of the debtor”.

Federal Law No. 69-FZ introducing amendments and addenda to the Federal Law No. 122-FZ on state registration of immovable property and its transaction.

The following amendments and addenda must be introduced to the Federal Law No. 122-FZ: 1) Article 12 must be supplemented with the following paragraph “Identification of the plot of land in the Common state register of rights shall be carried out in conformity with its cadastre number attributed thereto by state land cadastre institution”. 2) Item 1 of the Article 17 must be supplemented by the following passage “It is not necessary to make available cadastre plan of the plot of land if it has already been inserted in the dossier of legal documentation”.

En particulier, l’article 1er établit que le remembrement foncier a pour objet la réalisation de plans d'urbanisme, notamment l'exécution d'ouvrages d'intérêt public ou d'opérations d'aménagement, l'assainissement de quartiers insalubres ou vétustes, l'amélioration de l'aspect des quartiers ou l'utilisation plus rationnelle à des fins d'intérêt général des terrains disponibles.

These Rules provide for applications to the Registrar under the Commonhold and Leasehold Reform Act 2002, the form of the documentation which must accompany any application and the circumstances in which an application may be cancelled by the Registrar. Schedule 1 to these rules contains the various forms prescribed by them. Schedule 2 prescribes the wording of the restrictions prescribed by the rules.

Part I of these Regulations contains general provisions. Part II contains provisions about the registration of a freehold estate in land as a freehold estate in commonhold land.
