These Regulations amend, in relation to England and Wales, the Town and Country Planning General Regulations 1992, by excluding from the ambit of regulation 9 those planning authorities which are the sole local authority for their area, so that they may grant themselves permission which enures for the benefit of the land. Regulation 9 (effect of planning permission) of the principal Regulations provides an exception to the rule that planning permission enures for the benefit of the land.

These Regulations amend, in relation to England and Wales, regulations 14 of the Town and Country Planning General Regulations 1992 in relation to expenses for the recovery of land, which is in a condition adversely affecting the amenity of a neighbourhood. Under section 215 of the Town and Country Planning Act 1990, a local planning authority may in certain circumstances serve a notice on the owner and occupier of such land, requiring steps to be taken within a specified period to remedy its condition.

These Regulations amend, in relation to England, the Town and Country Planning General Regulations 1992, by stipulating that a grant of planning permission for development which falls within regulation 3 of those Regulations (other than development of any land by an interested planning authority or by an interested planning authority jointly with another person specified in the planning application) is attached to the land and shall be for the benefit of all persons for the time being interested in it.

This Order approves the Emergency Instrument to regulate natural resources uses within the Marine Reserve of Parnaíba River Estuary. This Instrument (in the Annex), consisting of 5 Chapters, specifies prohibited and authorized activities to be performed within the above mentioned area in: land, pollution, fisheries and forestry sectors. it establishes land tenure and land concession requirements, pollution control and quality standards, fishing methods and gears, prohibited mangue tree exploitation, etc.

This Regional Law establishes the modalities of classification of land areas as protected areas, specifying that the following land categories shall be considered protected areas: (a) protected natural territories; (b) environmental protection land; (c) recreational land areas; (d) land of historical and cultural heritage; and (e) particularly valuable land. Competent public authority for attribution to the aforesaid land categories the status of protected area shall be regional executive body and local government.

This Order amends, in relation to England only, the Town and Country Planning (General Permitted Development) Order 1995 with respect demolition in conservation areas, which will require planning permission. Such demolition is “relevant demolition” for the purposes of section 196D of the Town and Country Planning Act 1990, is not permitted development for the purposes of the Principal Order.

These Regulations designate a coastal area as a Special Protection Area in accordance with Article 4 of Directive 2009/147/EC of the European Parliament and of the Council on the Conservation of Wild Birds. The purpose is to ensure protection from disturbance, capture and damage to nests and eggs under Article 5 of the Directive for all species of birds, not just the birds listed on Schedule 3 (with the exception of those birds covered under Articles 7 for hunting and 9, where derogations are listed).

The purpose of this Regulation is to preserve the scenic value of outdoor recreational terrains in areas rich with wildlife within Oslo. The boundaries of the outdoor area is shown in map at a scale of 1:12 500 of September 2013. The exact boundaries of the area shall be marked in the forest. Administrative authorities may grant permission to create paths and trails, ensure sport activities do not conflict with conservation objectives, forest management initiatives in certain sub-areas should develop a more friendly forest area in line with conservation objectives.

Item 8 shall be amended to add the following wording: “Transfer of land of protected areas shall be performed after positive conclusion of environmental audit based on technical and economic substantiation and after public hearing on the issue”.

This Ministerial Decree establishes that transfer of forestland to land of other categories for purposes not related to forestry shall be authorized exclusively in the presence of positive conclusions of state environmental audit. Authorization for transfer shall be issued in the following cases: (a) impossibility of land tenure in accordance with previously established purposeful use of land; (b) modification of the boundaries of inhabited (urban) areas; and (c) classification of land as protected area.
