Regional Law No. 441-OZ “On some issues of granting of forest land plots to citizens free of charge for the length of service for limited utilization”.

This Regional Law establishes that forest land plots granted to citizens free of charge for the length of service for limited utilization shall be allotted to forest officers and staff of state hunting organizations (game managers and gamekeepers) for agro-forestry (haymaking, grazing, apiculture, growing of crops etc.). Land areas shall be established within the following limits: (a) arable land – 3 ha; (b) haymaking – 10 ha; and (c) other agricultural activities – 5 ha.

This Regional Law regulates the issues of conservation, protection, management and reproduction of recreational forests in urban areas with a view of creation of favourable environment for the population. It shall also regulate the issue of afforestation and reforestation in urban areas. Regional executive bodies shall be responsible for education of the population related to management, keeping and reproduction of green plantations in urban areas.

The scope of this Regional Law shall be to regulate social relations in the sphere of historical and cultural heritage, ensuring access thereto of citizens and conservation and promotion of historical and cultural habitats of the regional population. Objects of cultural heritage shall be classified as federal, regional and local (municipal). Cultural heritage on the regional territory shall be subject to mandatory registration and conservation. Objects of historical and cultural heritage shall include urban areas and landscapes, protected areas and urban parks and gardens.

El presente Ley modifica la Ley de Espacios Naturales Protegidos de Aragón, incorporando las nuevas figuras de protección de ámbito internacional, tales como las reguladas por la UNESCO, y trasponiendo igualmente el acervo comunitario, en especial lo referente a la Red Natura 2000, a la conservación de las aves silvestres, y a la conservación de los hábitats naturales y de la fauna y flora silvestres.

This Law establishes that public property can be movable and immovable objects, including plots of agricultural land and public forest. It establishes the terms and conditions for privatization of public property. Privatization of public property shall be performed in accordance with purchase and sale contracts. The following objects of public property shall not be subject to privatization: (a) subsoil; (b) water resources; (c) territorial water; (d) continental shelf; (e) state forest fund; (f) protected areas; (g) national parks; and (h) objects of cultural heritage.

The scope of this Law shall be acknowledgement of the right of ownership to land plots pertaining to the ownership (tenancy) of natural and legal persons of private law. It shall be also applicable to unauthorized land seizure related to the plots of land pertaining to public land. This Law establishes plenary powers of state bodies representing the interests of the state in the process of acknowledgement of the right of ownership.

This Regulation sets out the rules and procedures of the management and administration of natural protected areas and natural heritage sites falling under the authority of the state. The Regulation also covers rules and procedures of appropriation of such areas as well as managing the rules of selling, exchange and renting.

This Decree establishes the modalities of calculation of damages caused to forestry and compensation thereof. It is related to transformation of forestland in case of allotment thereof for purposes not related to forest management and/or deterioration of soil or productivity of forestland. Revenues from compensation shall be accredited to the Agricultural Development Fund and shall be used for financing of forest management.

This Act provides with respect to local government and local authority (i.e. a District Assembly, Town Assembly, Municipal Assembly or City Assembly) in Malawi. For the administration of local government, there shall be local government areas as set out in the First Schedule. This Schedule may be modified by the Minister. For every local government area there shall be an Assembly. An Assembly shall have certain powers with respect to land. Sometimes the consent of the Minister responsible land is required for dealings in land by an Assembly.

This Decree establishes the modalities of exoneration from payment of land tax for land plots under young plantations and young growth of forest species. Young growth shall be identified as such in accordance with the classification of State Forest Service applicable to afforestation and reforestation areas age of which shall not exceed the following parameters: (a) 40 years for coniferous species; (b) 40 years for broad-leaved hard-wooded species; (c) 20 years for broad-leaved softwood species (except for speckled alder); and (d) 10 years for speckled alder.
