Restrictions on Acquisition of Immovables Act (2012)

The Act provides the restrictions on the acquisition of immovables used as profit yielding land arising from public interest and the restrictions on the acquisition of immovables arising from national security reasons. For the purposes of the Act, public interest is, in particular, development of the management for specific purposes and sustainable management of immovables used as profit yielding land which contain agricultural and forest land.

The Act regulates return of and compensation for land expropriated for USSR Military Bases in Estonia. It stipulates that the land expropriated by the Republic of Estonia during the period between September 1939 and 23 July 1940 for USSR military bases shall be returned or compensated for to the persons whose land was expropriated or to the successors thereof, regardless of the manner in which the land was expropriated. Such land must be returned with all the buildings and structures situated on the land at the time of expropriation, if they have preserved.

This Law, consisting of 58 articles divided into four Chapters, provides for the regime of use of uncultivated lands and other community productive lands owned and managed by local communities integrated in the cooperative and social sector as means of production. This Act provides for the power of the Minister to acquire land for public purposes and related matters. The Minister may, whenever he or she is of the opinion that it is desirable or expedient in the interests of Malawi so to do, acquire any land, either compulsorily or by agreement, paying such compensation therefor as may be agreed or determined under this Act. The procedures for acquisition foresee a preliminary investigation, a Notice of intention to acquire and a Notice to surrender property.

This Act amends the Local Government Act in provisions concerning land matters consequential upon the enactment of the Land Acquisition (Amendment) Act 2016 and the Land Act 2016. Also the word "Local Authority" is replaced by the word " Local Government Authority" wherever it occurs in the principal Act and provisions regarding the delegation of functions to committee by an Authority, the disposal of land, the designation of an area as a rateable area, the valuation of property, and charges on property. Three new sections are inserted in the principal Act (78A-C).

The Act is enacted to perfect cadastral management, ensure land rights, and promote land use.In order to investigate cadastral registration in which the contents of rights are incomplete or inconsistent with the existing laws and regulations, after clarifying the content of rights and ownership, the authority concerned shall register again. The municipal or county (city) authority concerned shall investigate within its jurisdiction the land cadastre.
