Brandenburg Geo-Data Infrastructure Law.

The present Law enforces the Directive 2007/2/EC of the European Parliament and of the Council of 14 March 2007 establishing an Infrastructure for Spatial Information in the European Community (INSPIRE).The specific purpose of the Law is to create the legal framework for the geo-data infrastructure in Brandenburg being part of the national geo-data infrastructure. In particular, the Law shall ensure that such data are: a) sustainable, up-to-date and of first quality; as well as b) simply and easily accessible.

The present Law enforces the Federal Spatial Information Act of 5 October 2010. In particular, the present Law regulates the: a) enforcement of the Federal Spatial Information Act of 5 October 2007; b) collection and use of spatial information of the Canton and municipalities; c) establishment and running of the digital cadastre. The text consists of 31 articles divided into 7 Parts as follows: General provisions (1); Principles (2); Official survey (3); Digital underground cadastre (4); Transversal spatial information system (5); Organization (6); Penalties and final provisions (7).

The President, with a view of improvement of regulation of land relations and carrying out state control over land management and protection, decrees to set up land survey services within local executive bodies entrusted with the following functions: (a) state control over land management and protection, execution and quality control of land survey and land cadastre work; (b) expropriation and allotment of the plots of land; (c) enforcement of land legislation; (d) submittal to tax inspection of data related to land ownership by natural and legal persons; and (e) exposure of abandoned land.

Burgenland Geo-Data Infrastructure Law.

The purpose of the present Law is to lay down rules aimed at the establishment of the infrastructure for spatial information in Burgenland with a view to environmental policies and activities which may have an impact on the environment. For the purpose of the present Law “Iinfrastructure for spatial information” means metadata, spatial data sets and spatial data services; network services and technologies; agreements on sharing, access and use.

This Act allows the Minister to decide that the boundary of land or of any portion thereof should be more clearly defined or ascertained. For that purpose, the Minister may serve notice on the owner or occupier of any such land requiring him within the period specified in such notice, to clear, define, or otherwise ascertain the boundary of the land to the satisfaction of an official surveyor. A person who fails to comply with the terms of any notice shall be guilty of an offence.

Fencing Act (Cap. 190).

This Act makes provision with respect to agreements on the fencing of land and actual fencing. This Act shall apply to such areas as the Minister may, by statutory notice, declare. The Minister shall not apply this Act to any area unless the majority of owners of occupied farms in the area present and voting have expressed themselves in favour of such application at a meeting convened in accordance with this Act.

Regional Law No. 59-RZ “On objects of cultural heritage”.

This Regional Law regulates the issues of state protection, conservation, management and promotion of the objects of cultural heritage. Objects of cultural heritage shall be classified as of federal, regional and local (municipal) significance. Regional Government shall be responsible for identification, classification, registration of the objects of cultural heritage and mapping of the boundaries of protection areas around them.

Hamburg Land Survey Law.

The present Law lays down provisions relating to land survey in Hamburg. Article 1 of the afore-mentioned Law establishes that the tasks of surveying bodies are the establishment, management and delivery of geo-data including the necessary surveying work. Regional Law No. 801-01-ZMO “On cultural heritage”.

This Regional Law regulates relations in the sphere of conservation, protection and management of the objects of cultural heritage. Regional Administration shall ensure mapping of the boundaries of land areas containing objects of cultural heritage and state registration of the objects of cultural heritage. Identification of the objects of cultural heritage shall be performed by the by the authorized regional state institution in the sphere of cultural heritage.

Regional Law No. 120-ZKO “On objects of cultural heritage”.

This Regional Law establishes the particulars of state protection of the objects of cultural heritage, including conservation, management and promotion thereof. Regional Administration shall be responsible for validation of the boundaries and mapping of areas containing objects of cultural heritage, types of land tenure and land use planning in the aforesaid areas. Objects of cultural heritage shall be subject to mandatory state registration. Land areas containing objects of cultural heritage shall be classified as land of cultural heritage.

Regional Law No. 76-ZKO “On land-use planning”.

This Regional Law regulates relations in the sphere of land-use planning and issuance of authorization for construction. Land-use planning shall take into consideration ecological factors with a view of ensuring sustainable development of the territories. In case of absence of land-use planning documentation local government shall not be allowed land reservation, expropriation or transfer of land from one category to another. Land-use planning documentation shall contain mapping of the territory, including mapping of the boundaries of protected areas and mapping of agricultural land.
