La présente loi fixe les statuts et les attributions des autorités traditionnelles et coutumières. Les autorités traditionnelles et coutumières sont les sultans; les chefs de canton et les chefs de tribu; les chefs de groupement; les chefs de village et les chefs de ferrick, et sont choisies parmi les personnes issues de la lignée de la chefferie de la localité. Elles veillent à la protection et à la conservation du patrimoine coutumier.

This Act establishes the Land Administration Authority as a body corporate and provides with respect to its functions and powers and its administration and management. The Authority shall be an agency of the Government of Lesotho responsible for land administration and shall operate under the general supervision of the Minister responsible for land matters.

This Act provides for acquisition of lands by the Government for public purposes. No land shall be acquired by the Government: (a) unless the acquisition of the land or the purpose for which it is to be acquired has been expressly authorized by the Legislature (except for construction of roads). The acquisition of land by the Government shall be by means of purchase by agreement or by means of compulsory purchase as provided for in this Act. Part II concerns purchase by agreement between the Minister and the owner of the land.

The present Law enforces the Federal Agricultural Soil Act of 4 October 1991. In particular, the Canton promotes the efforts of the federal government to maintain an efficient agriculture according to the federal rural soil legislation and shall take the necessary measures for its implementation. The present Act lays down provisions relating to expropriation proceedings. The Act contains at the outset a definition clause relating to various terms employed therein such as, for example, “Board”, “expropriate”, “expropriating authority”, “injurious affection”, “owner”, registered owner”, “tenant”. Section 13 establishes that where land is expropriated, the compensation payable to the owner shall be based upon: a) the market value of the land; b) the damages attributable to disturbance; c) damages for injurious affection; and d) any special difficulties in relocation.

This Law provides for the acquisition of land needed for public purposes and for Companies, and determines the amount of compensation to be made on account of such acquisition. The Collector of the District may make a preliminary investigation on any land in any locality that may be needed for any public purpose or for a Company. The Commissioner, for land acquired for a public purpose, or the Provincial Government for land acquired for a Company, when satisfied of the result of the investigation, shall publish a notification in the Official Gazette.
