La présente loi détermine le régime de constatation, de détention, d'utilisation et d'exploitation des espaces fonciers du domaine urbain des personnes publiques et privées. Le domaine foncier est constitué par l'ensemble des terres et terrains qui sont affectés à l'usage du public ou considérés comme bien public par nature ou par destination. Le patrimoine foncier urbain est l’ensemble des terres et terrains appropriés selon les règles du code civil du régime de l’immatriculation ou de reconnaissance et de constatation des droits fonciers coutumiers.

This Act provides for the continuation of leaseholds and leasehold tenure as well as for the continued vesting of all lands in the President who has the power of alienation (land held under customary tenure is subject to certain conditions) (sect. 3). It also provides for the statutory recognition and continuation of customary tenure (sect. 7), for the conversion of customary tenure into leasehold tenure (sect. 8) and establishes a Land Development Fund and Lands Tribunal (Parts III and IV).

This Law provides for the establishment of the General Directorate of Land Registry and Cadastre under the Ministry of Public Works and Settlement.
