La présente loi porte modification des dispositions de l'article 3 du Décret- Loi n° 1/13 du 24 Novembre 1986 portant fixation des droits d’enregistrement en matière foncière, en fixant au 3 % le taux du droit prportionnel perçu par le Trésor public à l'occasion de toute mutation de propriété immobilière enregistrée.

This Act concerns the fencing of land. "Fence" means a fence separating the adjoining pieces of land of different owners and includes: (a) any gate, grid track, other than a grid on a main road as defined in the Roads Act, or stile and any other means of passage over or through the fence concerned; and (b) any ditch, hedge, railings or wall used as a fence. Part II of this Act prescribes that each magistrates court shall be a fencing court for the province in which it is situated prescribes the procedures of court proceedings.

These provisions supplement Law No. 9235 of 2004 with regard to the land rented to those commercial enterprises in which the State is a shareholder. In these cases, the Department of the Public Property Administration under the Ministry of Finance may sell lands at the market price when it is necessary for the exercise of its functions within the enterprise, in compliance with the criteria established by the Council of Ministers; whilst the rest of the land, if any, may be restituted to former owners.

El presente Acuerdo aprueba el Reglamento para la selección y adjudicación de solicitantes de tierras, que tiene por objeto regular los procedimientos a que deben someterse las personas solicitantes de tierras, (personas físicas o personas jurídicas sin fines de lucro), para el estudio y selección, ya sea para asentamientos campesinos de explotación individual o colectiva.

This Regional Law regulates the allotment, free of charge, of public land plots with delimited ownership and pertaining to the regional or municipal public land stock in ownership to some categories of citizens. The following categories of citizens shall have the right of allotment free of charge of public land in ownership: (a) multi-child families with three or more children; (b) single-parent families with dependent children of minority age with three or more children; and (c) single-parent family with three or more children of minority age, including adopted children.

This Regional Law sets forth the modalities of allotment of plots of land in ownership to citizens free of charge for gardening, horticulture, subsistence farming, family farming and commercial farming, to citizens with three children under age, citizens with disabled children and specialists in agricultural professions with university degree under age of 35 years working in rural areas. It establishes also minimum and maximum agricultural land area of plots of land that can be allotted in ownership free of charge.

This Law aims at transforming the system of public landownership into private property ownership. It is structured as follows: Chapter 1 (General provisions). Article 1 provides that the right of ownership shall be restored either by restitution of the actual property or through financial compensation. Article 2 lists the categories of citizens eligible for such restoration.

Part 1 establishes a right to be on land for recreational, educational and certain other purposes and a right to cross land. The rights exist only if they are exercised responsibly. Some of the provisions for that purpose are also extended in relation to rights of way and other rights. Part 1 imposes certain duties on local authorities in relation to access on and over land in their areas and, in particular, requires them to draw up and adopt a plan of core paths in their areas.
