Ce décret modifie et complète certaines dispositions du décret nº 76-165 fixant les conditions d'obtention du titre foncier. Les dispositions modifiées concernent, entre autre, la nullité du titre foncier et son retrait; la constitution du dossier nécessaire pour solliciter l'obtention d'un titre foncier sur une dépendance du domaine national et la procédure qui en suit; les procédures d'immatriculation par le conservateur foncier.

The President, for the purpose of increasing the efficiency of the state land resources, the conformation of the state management system to the new economic conditions, decrees as follows: 1) to set up the State Committee on Land Survey; 2) to entitle the aforesaid Committee with the functions of the keeping the state land cadastre, land monitoring and land survey, the state registration of ownership rights, carrying out the state supervision over the efficient use and the protection of land resources.

This Act makes provision for the incorporation of group representatives of groups formed under the Land Adjudication Act and contains rules relative to the administration of such group representatives and its property and the nomination and powers of the Registrar of Group Representatives. The Minister shall appoint a Registrar of Group Representatives to perform the duties and exercise the powers imposed and conferred on by this Act.

This Act makes provision for the administration of the adjudication of any area of Trust land designated by the Minister. The Minister may designate, by Order, Trust land to which provisions of this Act apply if: (a) the county council in whom the land is vested so requests; (b) the Minister considers it expedient that the rights and interests of persons in the land should be ascertained and registered; and (c) the Land Consolidation Act does not apply to the area.

This Regulation consists of 7 Sections divided into 23 articles. Section I establishes the Cadastre and Documentation Department of the Ministry of Justice and defines its duties. Section II deals with land ownership rights. Section III pertains to booking and registration. Section IV and V define the registration measures. Section VI defines steps and measures for the authentication of signatures, as well as fixes registration fees. Section VII contains temporary provisions.

This Law is composed of 4 Chapters divided into 25 articles. Chapter I deals with definitions and terms and defines the steps for the concession and exploitation of State lands. Chapter II provides for the definition of private State lands, concession rights, exploitation rights, ownership transfer and land leasing. Chapter III contains offences and penalties. Chapter IV gives general provisions necessary for the issuance of resolutions and regulations for the implementation of this Law.

The Regulation consists of 3 Sections dealing with the following matters: 1) general provisions (sect. 1); 2) the modalities of calculation of preferential value of land (sect. 2); 3) the modalities of valuation of agricultural land (sect. 3). The present Regulation shall be applicable for the calculation of preferential and normative value of land transferred in private ownership for subsidiary small-holding, housing and gardening. Land charges for land transferred in private ownership shall be compulsory for all citizens.

This Regulation of the Minister of Environment Protection, Natural Resources and Forestry is composed of four paragraphs. A forest or land designated for afforestation can be purchased in the following cases: the forest or land is directly adjacent to lands managed by the National Forests; there is no common ownership; the field forest border has been regulated. Other immovables can be purchased as long as it is justified by needs of forest management run by organizational units.

The President decrees to authorize the regional executive bodies to allot the citizens at their request for farming on condition of hereditary lifelong ownership the plots of land amounting to one hundred hectares excluding the plots of land conceded for housing and subsidiary small-holding. The plots of agricultural land shall be allotted for the organization of peasant farms. In case of crediting of peasant farms as the guarantee of the restitution of credit the property of peasant farms including agricultural crops shall be used as mortgage.

The Regulation consists of 6 Sections dealing with the following matters: 1) general provisions (sect. 1); 2) preparatory work (sect. 2); 3) field work (sect. 3); 4) laboratory work (sect. 4); 5) mapping (sect. 5); 6) legalization and issuing of land certificates (sect. 6). The purpose of agrochemical inspection of soil of peasant farms shall have as its purpose obtaining the reliable quantitative, qualitative and land valuation data in order to fill in the State land ownership certificate for hereditary lifelong possession of the plots of land.
