This Order amends the Town and Country Planning (General Development Procedure) Order 1995 so as to introduce further requirements to consult the Environment Agency before the determination of applications for development in flood zones.

El presente Decreto Legislativo aprueba el régimen jurídico para el aprovechamiento de las tierras de uso agrario, que declara de interés nacional y necesidad públca el desarrollo integral, competitivo y sostenible del sector agrario así como la conservación y el aprovechamiento eficiente de las tierras de uso agrario, con el fin de garantizar la seguridad jurídica sobre éstas.

La présente loi port Code de l'urbanisme. L'élaboration et l'exécution de la politique de l'urbanisme comportent la consultation de conseils ou de commissions où sont représentés les populations et collectivités locales intéressées, ainsi que les organismes socio-économiques, dans les conditions définies par la partie réglementaire du présent Code.

Ce décret porte des dispositions relatives à l’aménagement du territoire, coordonné le 22 octobre 1996. Le texte est formé par 73 articles répartis en 4 titres comme suit: Aménagement du territoire (I). Ce titre porte les chapitres suivants: Dispositions générales (I); Plans régionaux (II); Plans de secteur (III); Plans communaux (IV); Expropriations et indemnités (V); Remembrement et relotissement (VI); Révision des plans (VII).

The Commission is established under section 3 as a body corporate. It shall be the principal advisory and executive organ of the Government on all matters related to land use and conservation of the environment and shall formulate policies, act as co-coordinator of activities in the fields concerned and serve as a channel between bodies acting in the fields concerned and the government (sect. 4). Furthermore, the Commission shall develop standards formulate legislation and carry out all other functions listed in section 4.

These Regulations amend the Real Estate (Dealers and Developers) Regulations in provisions concerning: licences for dealers, registration of dealers, and fees for development. They also insert a new regulation 5A on conditions to e complied with by a developer who wishes to have discharged from any land a charge that has been executed and lodged with the Registrar of Titles in favour of the Real Estate Board.

This Act amends the Town and Country planning Act in relation with the extension of powers of municipal authorities to regulate and impose conditions regarding the establishment, quality and operation of construction sites and constructed-related operations regarding the soil.

The Land Code makes provision for the regulation of "land relations" and its purpose is to secure rational use and protection of land, the protection of the environment, and "the equal development of all forms of economic activity in Tajikistan" (Preamble). Other laws regulating land relations may be enacted on the basis of this Code.Land is declared to be in exclusive ownership if the State in article 2.

Article 11.1 shall be amended to add the following wording: “Boundaries of the area with identified objects of cultural heritage therein shall be validated by the district institution competent in the sphere of protection of cultural heritage. Data related to the aforesaid boundaries must contain textual description and graphic mapping”.
