This Regional Law establishes that size ceilings of the plots of land that can simultaneously pertain to private property of the citizens engaged in subsidiary small-holding are limited to 5 hectares. Utmost (maximum and minimum) size ceilings of the plots of land conceded to the citizens out of the stock of public or municipal land for subsidiary small-holding is established by the legal acts of the local self-government.

El presente Decreto Legislativo modifica la Ley que establece los principios generales necesarios para promover la inversión privada en el desarrollo de las actividades económicas en las tierras del territorio nacional y de las comunidades campesinas y nativas, respecto a la necesidad que las comunidades regularicen su organización comunal para la adquisición de las tierras comunales y dispongan del voto a favor de no menos del cincuenta por ciento de los comuneros posesionarios con más de un año.

Law No. 7698 on the Restitution and Compensation of the Properties of Some Ex-Proprietors.

The aim of this Law is to recognize ownership rights and to return to ex-proprietors or their heirs properties which were nationalized, expropriated or confiscated, as well as to determine methods and amounts for returning or compensating for lost properties or other rights. This Law does not apply to land regulated by the Land Law. The term 'land' used in this Law includes agricultural land as defined in article 3. Ownership shall be restored except in the cases as provided for in article 4.

The Ordinance is the general law on matrimonial property rights. In particular, it establishes administrative and legal proceedings and specifies that women are capable of holding, acquiring and disposing of any movable or immovable property as if she were a femme sole, without the consent or intervention of her husband. This applies to all property belonging to her at the time of marriage and property acquired or devolved to her after marriage. She also has the same remedies and redress by way of criminal proceedings for the protection and security of her separate property (16).

This Decree establishes the modalities of state registration of transfer of ownership of the plots of land in case of purchase and sale thereof and registration of land purchase and sale contracts. Land purchase and sale contracts shall be concluded in written form. The contracts shall be subject to notarized certification and transfer of land ownership shall be subject to state registration. The provisions of this Decree shall be applicable also to state registration of exchange of land plots contracts.

This Act, consisting of 3 Parts and 2 Schedules, establishes that all land which immediately prior to the commencement of this Act was vested in the Maori Trustee subject to the provisions of Part 14 or Part 15 of the Maori Land Act 1931 shall, at the commencement of this Act, become vested land subject to the provisions of this Act. On the commencement of this Act, all vested land shall cease to be subject to any trusts theretofore applying to the land, and the land shall be administered and dealt with in accordance with the provisions of this Act.
