The Constitutional Court has passed the following ruling: “To recognise that the norms of Parts 1 and 2 of Article 6 of the Republic of Lithuania Law on Land regulating the rights of institutions of local self-government in the sphere of the possession of State land as well as Article 24 of the said law are in compliance with the Constitution of the Republic of Lithuania. This Constitutional Court ruling is final and not subject to appeal. The ruling is promulgated on behalf of the Republic of Lithuania.”

El presente Decreto modifica el que reglamenta la Ley que adopta medidas para la prevención del desplazamiento forzado y la atención, protección, consolidación y estabilización socioeconómica de los desplazados internos por la violencia, en relación a la disposición que establece que los notarios se abstendrán de autorizar escrituras públicas de actos jurídicos que impliquen transferencia de dominio de predios rurales ubicados en zonas de desplazamiento, mientras los solicitantes no aporten copia del certificado de libertad y tradición.

This Decree establishes the modalities of state registration of transfer of ownership of the plots of land in case of purchase and sale thereof and registration of land purchase and sale contracts. Land purchase and sale contracts shall be concluded in written form. The contracts shall be subject to notarized certification and transfer of land ownership shall be subject to state registration. The provisions of this Decree shall be applicable also to state registration of exchange of land plots contracts.

Foreign legal or natural persons may acquire the ownership of real estates, other than arable land or protected natural area, after obtaining the permit of the responsible public administration office of Budapest or the county. The permit has to be issued if the acquisition of ownership by foreign persons does not hurt the local government's or other public interest, and if the buyer does comply with certain requisites. The issuance of a permit may be refused if Hungarian persons are not treated equally, in this regard, to local people in the country of origin of the buyer.

This Decision of the Council of Ministers declares that the Regulation on sales procedure of olive, fig, hazelnut, citrus and fruit plantation areas owned by foundations of 1953 is repealed. The decision consists of three provisions which are governed by the Council of Ministers.

Repeals: Regulation implementing Law No. 6092 on sales procedure of olive, fig, hazelnut, citrus and fruit plantation areas owned by foundations. (1953-11-20)

Article 1 shall be amended to add the following wording: “Privatization of agricultural land plots pertaining to regional or municipal public ownership shall be performed in accordance with Land Code and federal legislation three years after entry into force of this Regional Law”.

The present Act provides for a centralized assessment system for real property taxation. In particular, for property tax purposes, the Taxation and Property Records Division of the Department of Finance, Energy and Municipal Affairs assesses the value of all real property within the Province. Taxing authorities use property assessments to determine the tax rates needed to raise the revenue required to pay for public services. Taxation and Property Records sends property owners a Statement of Account - Property Charges that shows assessed values and the applicable charges.

Article 4 shall be amended to add the following wording: “In case of previous allotment of a plot of land free of charge to a citizen in accordance with acting land legislation, except for case of allotment of plot of land free of charge to citizens in ownership out of stock of land allotted to non-governmental entity set up by citizen, the citizen shall have no right of allotment of plot of land in ownership free of charge in accordance with this Regional Law”.
