El presente Acuerdo crea la Comisión Técnica de Consultoría del Programa de Regularización y Administración de Tierras Rurales (PRAT), con la finalidad de precautelar los intereses institucionales en los aspectos técnicos y económico precontractuales.

Customary Law (Bikini Atoll) Act 1994.

This Act declares customary law pursuant to Article X, Section 2 of the Constitution of the Republic of the Marshall Islands in respect of right, title and interest in and to Bikini Atoll in the Ralik Chain. As a result of the circumstances attributed to the long time span of the legacy and influence of foreign domination, the customary law shall, have limited force and effect with respect to specified rights and activities.

This Act stipulates that no person or body of persons recognized in pursuance of the a specified decision of the High Court shall after the date of commencement of this Act assert or exercise any title, right or power of Iroij Laplap with respect to the subject matter thereof which may be asserted or exercised by only such person as shall be entitled thereto according to the rules of customary law.

This Act consists of 54 sections divided into 5 Parts: Registration (I); Investigation of Title (II); Alienation of Niuean Land (III); Surveys (IV); Miscellaneous Provisions (V).There shall be kept in the Land Registry a Land Register of Niuen and Crown land. The Order deals with the limitation of land property by terms of its size that must not exceed 100 bights if the land is owned by family or individuals. The amount of exceeding land must return to the Government. An exemption is liable to be apllied in case of land owned by religious organization, farmers’ cooperatives or if tea, rubber, cocoa or coffee are being cultivated there; or when its use is being taken in account for industrial projects, when considered beneficial to the public interest.

The Act deals with the transfer of property from an individual to another by means of sale, mortgage (as per point a), lease, exchange (i.e exchanging the property of land with crops) or donation. In this last case, donation must be accepted by the person in the course of the donor’s lifetime. If the recipient dies before having accepted the donation, this shall be considered null.

El presente Decreto modifica el Reglamento de la Ley Nº 26505, estableciendo que quienes se dedicaran a alguna actividad agropecuaria dentro del área de los proyectos especiales hidráulicos ejecutados con fondos públicos, pueden adquirir la propiedad de las áreas que explotan.

La presente Ley dispone que la Agencia de Promoción de la Inversión (PROINVERSIÓN) procederá, dentro del total de la extensión de tierras habilitadas o eriazas de los proyectos especiales hidroenergéticos y de irrigación del país financiados con fondos públicos y/o cooperación internacional que se encuentren disponibles, a adjudicar directamente mediante compraventa a través de sorteo público hasta el treinta por ciento del total de estas tierras, las mismas que serán destinadas a módulos de pequeña propiedad.
