Law on farming land and gardens.

The present Law lays down provisions relating to farming land and gardens. Article 1 establishes that a Farming Land Commission shall be nominated. This Decree establishes that condominium shall be considered non-governmental entity, non-commercial organization having the status of legal person. The purpose of condominium shall be maintenance, management and conservation of housing facilities and plot of urban land provided with amenities. The aforesaid plot of land shall be allotted to condominium on term of common (shared) property. Condominium shall be granted the right to determine types and modalities of land tenure.

Item 5 of the Article 4 shall be amended to add the following wording: “Maximum land area of the plots of land allotted in ownership or granted in accordance with other rights to citizens carrying out subsidiary small-holding shall not exceed 0,5 ha. Maximum land area can de extended by regional authorities but shall not exceed fivefold with reference to the original area of 0,5 ha.”

Parliamentary Resolution “On prohibition of purchase of agricultural and forest land by foreigners”.

The Parliament establishes that until 30 April 2014 purchase of agricultural and forest land by foreigners shall be prohibited and purchase and sale contract related to purchase of agricultural and forest land by foreigners shall not be concluded.

Ordinance on land consolidation and boundary adjustment.

The present Ordinance enforces the Land Use Planning and Building Law of 14 May 1987. Land consolidations shall be effected in view of building land, land not designed as such shall be re-allocated. The text deals with the following aspects: definition of terms, sphere of application, cooperatives, purpose of land consolidation, survey, principles of allocation, costs, administrative proceedings, legal protection and entry into force. The text consists of 35 articles divided into 3 Parts as follows: Land consolidation (I); Boundary adjustment (II); Final provisions (III).

Law No. 91-XVI “On public land and delimitation thereof”.

This Law regulates delimitation of public land and land pertaining to local self-government. The Act consists of 5 Sections divided into 11 articles: (1) general provisions; (2) public land; (3) land of local self-government; (4) transfer of the right of land ownership; (5) conclusive and transitional provisions. Public land shall be inalienable property, it shall not be subject to levy execution and time limitation of prescription, nor can it be used as property bond or purchased by third party. Public land can be only conceded in use, concession or lease.

This Law establishes terms and conditions for ownership, use and disposal of state property and property of local self-government and, in particular, land, inland waters, parks and subsoil. The Act consists of 4 Sections divided into 24 articles: (1) general provisions; (2) purchase of state property and property of local self-government; (3) ownership, use and disposal of state property and property of local self-government; and (4) concession and writing off of state property and property of local self-government unfit for use.

Ministerial Decree No. 177 validating the Regulation on allotment of land for housing.

This Ministerial Decree establishes the modalities of allotment, in case of availability, of land for housing free of charge. Allotment of land for housing shall be carried out in accordance with general land-use planning schemes. Objects of allotment shall be plots of land located in inhabited areas that can be conceded in ownership. Dimensions of the plots of land for housing shall be determined by the local self-government.

This Law establishes that land plot ownership right shall be attested by privatization documents in case of absence of such in accordance with cadastre plan elaborated by state land survey service. Privatization documents and cadastre plan shall be the grounds for registration of ownership right to the plot of land.
