This Ministerial Decision implements the Decree that regulates the right of use and conditions for exploiting public land by establishing the procedures for consultation with the local communities on the use and property rights of land. The local community's consultation includes two phases. The first is a public meeting in order to provide information to the local community on the application for acquisition of land use rights and the identification of the boundaries of the parcel. The second relates to the duration of the consultation.

This Law establishes that land plot ownership right shall be attested by privatization documents in case of absence of such in accordance with cadastre plan elaborated by state land survey service. Privatization documents and cadastre plan shall be the grounds for registration of ownership right to the plot of land.

This Law regulates relations concerning municipal property and, in particular, land relations. Article 3 establishes that public parks, urban green belts, forests and agricultural land not pertaining to protected areas can be in municipal ownership. Article 5 states that municipal property can be obtained through transfer, purchase, donation, exchange and expropriation. Article 12 establishes that objects of municipal property can be privatized by natural and legal persons. Article 15 establishes that municipal property can also be conceded to natural and legal persons on lease.

La présente ordonnance met en exécution, entre autres, la loi du 16 juin 1997 sur la procédure des améliorations foncières et forestières. L’article 1er établit que la présente ordonnance régit toutes les améliorations foncières et forestières conduites avec la participation des pouvoirs publics. La présente loi met en exécution la loi fédérale du 3 octobre 1951 sur l'amélioration de l'agriculture et le maintien de la population paysanne. The aim of this Proclamation is to improve management and utilization of land and land resources for agricultural purposes. It applies to all land that lies outside of municipal borders. The Proclamation defines the right to acquire, free of charge, rural land by adult residents of the region, whose livelihood depends on agriculture, and other subjects. It also defines land use rights of peasants, pastoralists and semi-pastoralists and provides for the protection of such rights.

This BMZ comissioned report by GTZ highlights the dramatic increase of land concessions and rising inequality in land distribution in Cambodia. Parts of the study refer to an earlier report by Uch Sophas “Foreign Direct Investment in Land for Biomass Production in Cambodia”. The South-East Asian country Cambodia has an area of 181,035 km2. The Government of Cambodia is adapting its activities to attract FDI, which has lead to a steady increase especially since 2007.

This Federal Law regulates relations originating from creation of artificial land plots on waterbodies pertaining to federal property. Artificially created land plot can adjoin existing land plots or be separated therefrom. Initiators of creation of artificial land plots can be federal executive bodies, regional executive bodies, local self-government, natural persons, including individual entrepreneurs, and legal persons. Authorization for creation of artificial land plot shall be granted by the Government, authorized federal executive body and regional executive body.

This Act concerns rights of persons entitled in possession to land under a contract of tenancy whether express or implied. It provides protection of such rights. It does not apply to a tenancy of agricultural land.The Act provides for conversion of tenancies to which this Act applies subsisting immediately before the appointed day shall as from the appointed day in a statutory lease for the purposes of this Act. It also provides for an option to purchase the land under tenancy by the tenant.

The national land centre informs the general public that requirements for property transfers have been simplified as follows: 1. notarisation of a sale contract is now optional for land under commercial or industrial use. however, sale contracts that are not notarised are required to be signed by both parties infront of the registrar or deputy registrar of land titles, during submission of the application for property transfer.
