This Act contains provisions on the planning of land, water and construction. The purpose of these provisions is to promote community development and sustainable living environment. The Act regulates urban and rural landscape planning in municipalities, safeguarding cultural sites, management of energy, water, climate, waste, transport and hygiene conditions. Land Reserve and public places: zoning municipalities may determine land reserves allocated for road (traffic and transport) and energy (network and cabling) activities.

This Regional Law establishes cases of allotment of public and municipal land parcels free of charge to some categories of citizens for individual construction to the following categories of citizens: (a) citizens with three or more children under 18 years of age; (b) young families, and single parents of maximum 35 years of age; (c) persons deprived of the only one housing facility as a result of natural or technological disaster; and (d) persons with handicapped children. Allotment of land parcels free of charge to the aforesaid categories shall be performed once-only.

This Regional Law establishes maximum total land area that can be owned or belong in any other form to citizens carrying out subsistence farming. Maximum land area of agricultural land cannot exceed 2 ha per each subsistence farm. In case of excess of the aforesaid limit the exceeding land area must be expropriated within one year from the date of origin of the aforesaid rights or within the same time period the citizen must be registered as individual entrepreneur in the form of peasant farm.

This Regional Law establishes minimum and maximum land areas of public and municipal land to be allotted to regional residents in ownership for farming, gardening, horticulture, stockbreeding and suburban housing construction. It shall not be applicable to agricultural land and it shall not be applicable to purchase of land in ownership by citizens.

This Regional Law regulates turnover of agricultural land with a view of conservation of precious productive agricultural land. It establishes minimum agricultural land areas resulting from land consolidation for open land - 1 ha, for areas under glass - 0,05 ha. Minimum agricultural land area for drained and irrigated agricultural land shall not be less than 100 ha. Maximum agricultural land area that can be owned by a single natural or legal person within the boundaries of a single municipal unit shall not exceed 10 percent of total available agricultural land area.

Article 8 shall be amended to add the following wording: “Public land plots shall be allotted to citizens and legal persons for purposes non-related to construction in ownership, permanent (open-ended) tenancy, tenancy for a determined period free of charge or in lease in accordance with the acting legislation”.

This Regional Law establishes priorities of the regional land policy as follows: (a) conservation of most valuable land; (b) conservation of agricultural land and protected areas; (c) realization of the right of regional residents to land allotment; (d) land tenure by methods ensuring conservation of ecosystem; and (e) payment of land charges for land use. Public and municipal land can be allotted to citizens in ownership, on lease, permanent (open-ended) tenancy or fixed-term tenancy free of charge.

The present Law implements the Federal Land Parcel Act (BGBl. I p. 1091) of 28 July 1961. Article 1 establishes that the sale of land up to a size of 0.25 hectare does not require any authorization according to the aforementioned Federal Act. The text consists of 2 articles.
