La presente Ley establece que el ordenamiento territorial constituye una política de Estado que, incorporándolo a la planificación nacional, promueve la gestión integral, estratégica y eficiente de todos los recursos de la nación. Se crea el Consejo Nacional de Ordenamiento Territorial (CONOT) con la finalidad e proponer, concertar y dar seguimiento a las políticas y planes en materia de ordenamiento territorial.

“Customary land”, “private land” and “public land” shall bear the same meaning in this Act as in the Land Act. The Minister may apply the provisions of this Act to areas in which, according to the Minister, ascertainment of interests in customary land or the agricultural development of such land require the application of provisions of this Act.

This Law establishes the conditions and the modalities of realization on investment activity aimed at building of the plots of land, for completion of unfinished constructions, reconstruction of edifices, their parts belonging to St.Petersburg for the purpose of profiting when the result is creation of immovable property. Article 7 establishes that investment prospect must contain the obligation of a potential investor to pay the services of the preparation of urban construction and land surveying documentation.

These Regulations amend the principal Regulations by revoking the Fourth Schedule and substituting therefor the Schedule attached to these Regulations. The Fourth Schedule concerns trial surveys as provided for by section 8 of the Land Survey Act and regulation 77a of the principal Regulations. A trail survey shall be carried out by aspirant land surveyors in accordance with directions set out in the Schedule.

This Act concerns land survey i.e. the establishment, location or definition on the ground of any boundary, limit or angle of any land, size, location, parcel, claim, common, easement, road, street, lane, district, municipality, country of township, or any other location or division of lands or right over lands whether for ownership, title or authority of the origin of any of them. Under section 2, a Chief Surveyor shall be appointed and sections 3 to 8 are dedicated to the coordinate system to be established in Prince Edward Island.

Ministerial Decree No.493 of 1991 regarding validation of the form of the official document attesting the right of ownership to the plot of land, life-long hereditary property, and open-ended (permanent) land tenure.

The Government decrees to validate the forms of the official document attesting the right of ownership to the plot of land, life-long hereditary property, open-ended (permanent) land tenure of citizens (Form No.1), enterprises, institutions, organizations and peasant farms (Form No.2).Regional Governments, territorial, provincial executive bodies and executive bodies of the autonomous territories, the state Committee on Land reform and Support of Peasant farms must provide for carrying out land-survey activity related to legalization and issuing the afore-mentioned official documents.

The Supreme Soviet, for the purpose of improvement of the legislation, decrees to introduce the following amendments and addenda to the Law on Land reform: 1. In the first, second and third parts of the article 5 the wording “State Committee of the Republic of Tajikistan on Land Reform and Land Survey”, must be substituted by the following wording “State Land Surveying Service attached to the Ministry of Agriculture”. 2.

Directive No. 245-TTg on urgent work to be done concerning the management and use of land by those local organizations which have been allocated land by or have leased land from the State.

The Directive aims at preventing illegal expropriation, misuse or abuse of land and mismanagement of land rent, by ordering and providing for an inventory of all organizations and individuals that have been assigned land by the State or are directly managing and using land; those same organizations or individuals are compelled to provide the competent Authorities with the total land area measurements, the use they are doing of that land and to comply with land lease payment.

The present Regulation determines the modalities of ensuring protection of geodetic points. Geodetic point consists of special centre, external identification mark and external design represented by a ditch or bank that is the external boundaries of a geodetic point. Protection zone of a geodetic point is a plot of land on which it is situated and the strip of land of the width of 1 metre adjoining the external boundary of the geodetic point.
