Law regulating the sale of land under dams and rivers, 1939.

This Act makes rules for the sale of public land that has been rendered habitable or arable through Government waterworks. The purpose of the sale is to populate these areas. A Commission shall be formed to carry out land measurements, to prepare the plans of land to be sold and to establish prices. Lands shall be divided into three categories according to their potential use and be priced accordingly. No private lands shall be included into the charts of sale and “the rights of original owners will not be impaired”.

This Decree prescribes the implementation of the Land Law of 2003. It deals with the following matters: land price-determining methods, price brackets for assorted land categories; land use levy and land rent collection; compensation, support, resettlement when the State recovers land for use of defence or security purposes, for national interests, public interests, economic development; land inspection; sanctioning of administrative violations.

There shall be appointed a Commissioner of Lands and Surveys who shall, subject to this Act: (a) direct, supervise and control all public surveys; (b) ensure that all surveys and plans are effected in accordance with the laws of Belize. The Commissioner may by notice published in the Gazette delegate any of his or her functions under this Act to any officer of the Lands and Surveys. The Land Surveyors Board is established under section 4. The Board shall issue licences to practice land surveying in accordance with this Act. The Board shall keep a register of licensed surveyors.

Rules to implement provisions of the National Lands Act. Except in special cases approved by the Minister, national lands, other than town or village lots, will be disposed of only by way of grants. All mines of gold and silver and other metals and minerals, all ancient monuments, mounds or relics within the meaning of section 12 of the National Lands Act and all forest produce are strictly reserved and do not pass under the grant nor lease.

This Law provides for the institution of the national Cadastre and Survey Organization, its functions and powers, involving activities dedicated to the management of cartography and topography of land. It is a public organization under the responsibility of the Ministry for the Environment, Physical Planning and Public Works. It is presided by a seven members Committee. The Committee’s mandate has duration of three years and may be re-elected without any restriction.

Rotuma Lands Act.

This Act provides for various aspects relative to dealings in land in Rotuma and provides for the appointment of the Rotuma Lands Commission. The Commission shall ascertain (traditional) land rights, resolve disputes relative to land rights, demarcate land and register land rights (sect. 4). All land found by the Commission to be un-owned shall vest in the Crown in trust for the Rotuman people, but shall not be considered to be Crown land. All moneys derived from such un-owned land shall be paid into the Rotuman Development Fund and be used for the purposes of that Fund.

This Act provides for the efficient management of land and the protection of ownership by registering the information concerning land in a cadastral record and managing it after conducting its survey and measurement, and by prescribing the matters related to the furnishing of registered information.
